​Litigators and parties involved in court proceedings will be aware that courts have the discretion to award interest on damages. From 1 July 2010, the method used to calculate pre judgment interest changed. Interest is now determined by reference to the Reserve Bank of Australia cash rate plus 4 percent.

This approach has been adopted across Australia, with corresponding updates made to the NSW Court Practice Notes and the Federal Court Practice Notes.
